Decree 341/2026/ND-CP: What Import and Export Businesses Need to Know About Civil Cryptographic Products
Date Submitted: 2 giờ trước

On September 1, 2026, the Vietnamese Government issued Decree 341/2026/ND-CP, detailing several provisions and implementation measures of the Cybersecurity Law regarding civil cryptography.

This regulation is particularly important for businesses involved in the import, export, or trading of electronic devices, networking equipment, and products with encryption functions. If a product falls under the regulated category but its import policy is not verified in advance, businesses may face licensing requirements, customs clearance delays, and disruptions to delivery schedules.

How Does Decree 341/2026/ND-CP Affect Import and Export Activities?

One of the key provisions of the Decree concerns the import and export of civil cryptographic products.

Under the regulation, businesses importing or exporting products listed in the List of Civil Cryptographic Products Subject to Import and Export Licensing must obtain an Import and Export License for Civil Cryptographic Products before carrying out the transaction.

The license is issued by the Government Cipher Committee of Vietnam and remains valid for the period specified in the Decree.

Not Every Electronic Device Requires a License

Many businesses mistakenly assume that every electronic or security-related device automatically requires an import license. In reality, this is not always the case.

Whether a product falls under regulatory control depends on several factors, including:

  • The product's HS Code

  • Product name and description

  • Technical specifications and encryption-related functions

  • The official List of Civil Cryptographic Products

For this reason, businesses should verify the applicable import policy before submitting customs declarations to avoid additional documentation requirements or customs clearance delays.

Product Categories That Require Special Attention

Below are several common product categories that may be related to civil cryptography regulations and should be reviewed before importation.

1. Networking Equipment with Encryption Functions

These products are widely imported by IT and telecommunications companies.

Cisco C1111-8P 10-Port Integrated Services Wireless PoE Router - VoIP Supply               Fortinet FortiGate 200E (FG-200E) | Buy for less with consulting and support                 Sophos XGS 107 Firewall Hardware Appliance [XA1ZTCHEU] - Avanet

Cisco ISR (IPsec VPN)                       Fortinet FortiGate                             Sophos XGS

These devices commonly integrate encryption technologies to protect data transmitted across networks.

2. Storage Devices with Data Encryption

Many storage devices now come with built-in hardware encryption.

Samsung T7 Touch 1TB Portable SSD - Black             Pen Drive 8GB Kingston IronKey Keypad 200 | KaBuM!

           Samsung T7 Touch                               Kingston IronKey

These products often include encryption features and should be assessed based on their technical specifications.

3. Authentication and Information Security Devices

These products are commonly used by enterprises, banks, and data centers.

Yubico YubiKey 5 USB-A and NFC Two-Factor Authentication Security Key - 5060408461426 | Mwave                Bot Verification                  chip on chipcard

    YubiKey                                HSM                                          Smart Card

These devices are designed for authentication, encryption key management, or secure access control.

4. Telecommunications Equipment

Some telecommunications products also integrate encryption capabilities.

End to End Call Encryption – Gabbit         Cambium Networks XV3-8 Wi-Fi 6 Indoor Access Point (XV3-8X00A00-RW) | Optace Networks          CCG-1520-T | 無線ネットワーク | Moxa | IBS Japan 株式会社

Enterprise VoIP phones                           Enterprise Wi-Fi                   Industrial 5G modems

Important Note: The examples above do not automatically require an import license. Licensing requirements depend on the product's HS Code, technical specifications, and whether it falls within the regulated list under Decree 341/2026/ND-CP.

Electronic Devices That Do Not Automatically Require a License

Many common electronic devices are generally not automatically classified as regulated civil cryptographic products, including:

High Quality Display LCD Monitor 18.5 Inch Office Monitor Computer 17 19 20 22 24 Inch Cheap Price LED PC Monitor - Curved Monitor and PC Monitors price          CAD PC | Intel Core i7-8700 | Nvidia Quadro K620 2GB | 32GB RAM | 1TB NVMe SSD | Windows 11 | WLAN & Bluetooth | Maus & Tastatur | Libre Office | 4260561743143         Zvučnici - Elipso

Computer monitors                 Keyboards and mice             Computer speakers

Takealot.com: Online Shopping | SA's leading online store         Cables USB Temium KIT Câble Ethernet/HDMI/USB | Darty

Standard USB webcams          HDMI, USB, and LAN cables

However, businesses should still verify import policies if these products include dedicated encryption functions.

What Should Businesses Prepare Before Importing?

To ensure smooth customs clearance, businesses should follow these steps:

Step 1: Identify the exact product name, model, functions, and technical specifications.

Step 2: Determine the correct HS Code.

Step 3: Compare the product against the List of Civil Cryptographic Products Subject to Licensing.

Step 4: If the product falls under regulatory control, apply for the required license from the Government Cipher Committee before importation.

Step 5: Check whether any additional specialized regulatory requirements apply.

Why Should Businesses Verify Policies Before Shipment?

For technology products, determining import requirements during the quotation stage or before shipment offers significant advantages.

Without prior verification, businesses may encounter:

  • Missing import licenses

  • Additional document processing time

  • Customs clearance delays

  • Delivery schedule disruptions

  • Increased logistics costs

This is especially important for products with VPN capabilities, data encryption, authentication functions, or integrated cryptographic technology.
